Terms of service

These terms are an agreement between you (“you”, the business using Emriel) and Emriel (“we”). By creating an account or using Emriel you agree to them.

1. What Emriel does

Emriel is an AI agent that researches the segments you approve, builds and verifies a lead list, sends outreach from its own domains, handles replies, and passes interested prospects to you.

2. Sales opportunities and pricing

You pay $10 for each sales opportunity. A sales opportunity is a prospect in one of your approved segments who replies to our outreach showing interest, for example by asking a question, asking for more information, pointing us to the right person, or saying they're open to a conversation. Auto-replies, out-of-office messages and “not interested” replies are not sales opportunities.

A sales opportunity is not a booked call and not a guarantee that a prospect will buy. There is no setup fee, minimum or monthly fee unless we agree otherwise in writing.

3. Billing

We bill sales opportunities monthly in arrears to the payment method on your account. Prices exclude taxes, which we add where required. If you believe a reply was counted wrongly, tell us within 14 days and we'll review it and credit it if it doesn't meet the definition above.

4. Your responsibilities

• Give us accurate information about your business, product and pricing. Emriel uses it when answering prospects.
• Only approve segments you're allowed to contact, and don't use Emriel to promote anything illegal, misleading or harmful.
• Handle the prospects we pass to you lawfully, including honouring opt-outs.
• Keep your login secure. You're responsible for activity on your account.

5. Our responsibilities

We'll run the service with reasonable skill and care, send from our own domains and inboxes, honour opt-outs, and comply with the email and data protection laws that apply to our sending. We process prospect data as described in our privacy policy.

6. No guaranteed results

Results depend on your market, offer and segments. We don't promise a set number of sales opportunities, which is why you only pay for the ones you get.

7. Intellectual property

You own your business information and the prospects passed to you. We own Emriel, its software and the email copy and models it uses, and grant you the right to use the service while your account is active.

8. Liability

To the extent the law allows, neither of us is liable for indirect or consequential losses, such as lost profits, and our total liability under these terms is limited to the amount you paid us in the 12 months before the claim. Nothing here limits liability that can't legally be limited.

9. Ending the agreement

You can stop at any time from your dashboard or by emailing us. We can suspend or close an account that breaks these terms. Sales opportunities delivered before the end are still payable.

10. Changes and governing law

We may update these terms and will email you about significant changes before they take effect. These terms are governed by the laws of the jurisdiction in which Emriel is incorporated, and its courts have exclusive jurisdiction.
